FELIX Kitten Factor Terms and Conditions

  1. These Terms and Conditions shall apply to the FELIX Kitten Factor promotion that will run on www.catslikefelix.co.uk/mischief. The promoter does not guarantee continuous, uninterrupted or secure access to the www.catslikefelix.co.uk/mischief website. Numerous factors outside of the control of the promoter may interfere with the operation of the website.
  2. This promotion is open to UK, Channel Islands, Isle of Man and the Republic of Ireland residents only, who have registered at www.catslikefelix.co.uk/mischief, www.purina.co.uk, or any other website operated by Nestle Purina PetCare (UK) Ltd; excluding employees and representatives of Nestle Purina PetCare (UK) Ltd, or any affiliates or subsidiary companies, their agents or families, or any other party professionally involved with this promotion.
  3. Participants must be 18 years of age or older at the time of their participation in the promotion.
  4. By taking part in the campaign, the Participants automatically agree to the Terms & Conditions that apply for this promotion.
  5. The promotion shall commence on 17th May, 2010 and shall run until midnight on 12th September, 2010.
  6. A Participant is defined as follows: anyone who completes the details in the ‘Registration’ and ‘Upload’ areas online or anyone who submits a completed postal entry form. Providing invalid details will result in disqualification. It is mandatory for a Participant to submit a written description and a photo. Suspicion of submitting material that doesn't belong to the Participant will result in disqualification.
  7. Participants should agree to comply with the Terms & Conditions that apply for this promotion, by checking the opt-in box in the submission screen or on the postal entry form.
  8. To enter the FELIX Kitten Factor search – the Participant must upload a photo of their kitten to www.catslikefelix.co.uk/mischief and tell us why they believe their kitten is Britain’s most mischievous in no more than 100 words. Alternatively the Participant can post the entry to ‘FELIX Kitten Factor, Clarion Communications, The Griffin Building, 83 Clerkenwell Road, London, EC1R 5AR. Postal entries will be uploaded to www.catslikefelix.co.uk/mischief.
  9. £1 for every entry will be donated by Purina PetCare to Cats Protection Registered Charity 203644 (England and Wales) and SC037711 (Scotland).
  10. Material, submitted name of kitten, location and reasons why your kitten is the most mischievous in Britain may not be of any explicit sexual, political or racist nature, contain brand names, inappropriate (swear) words, telephone numbers or other website addresses. Material submitted may not show any kitten or other animal, including humans, being harmed, harming itself or in harm’s way. All such entries will automatically be disqualified and will not appear on the website. Participants submitting information that is disqualified will not be explicitly notified of the disqualification.
  11. Disqualification of any entry is subject to the discretion of Purina PetCare.
  12. At its own discretion, Purina PetCare will have the right to refuse, not upload or remove uploaded content, and no correspondence will be entered into regarding such decisions.
  13. Purina PetCare reserves the right to exclude submissions that it believes to be fraudulent.
  14. Once a participant has submitted material, including valid details, he/she will have a chance to win the promotion. Entrants must not enter or use the website on behalf of another individual without that individual’s express permission. Online, only one entry per login will be accepted. Only one entry per household will be allowed, whether online or by post. Only one entry per email address or per envelope will be allowed.
  15. All submitted material may be edited by Purina PetCare for PR and Marketing purposes.
  16. It is a condition of entry that winners will grant the promoter an exclusive right for Purina PetCare to use their entries for any or all marketing purposes for a period of three years from the submission of their entries, without reward or recompense other than the award of the prize.
  17. By entering into the competition, Participants may be required and must agree to take part in PR activity relating to the promotion. The winner of the FELIX Kitten Factor will win £1,000 and 92 x 12 x 100g FELIX Multipacks. This is a year’s supply of FELIX food based on the average consumption per cat as determined by the promoter.
  18. 11 runners up will each win 23 x 12 x 100g FELIX Multipacks. This is a three month supply of FELIX food based on the average consumption per cat as determined by the promoter.
  19. No cash alternatives or other alternative prizes are available.
  20. The general public will be able to vote for their favourite kittens.
  21. Voting is strictly on the basis of one vote per person.
  22. No vote will be accepted until email validation has been received.
  23. Purina PetCare reserves the right to exclude submissions if it believes multiple email addresses have been created in order to place multiple votes.
  24. The overall winner and runners up will be selected from the 25 kittens with the most votes. The judges will choose the winners and runners up based on the mischievousness of the kitten (fun, mischievous, independent, cheeky, playful, full of surprise) which will be decided by the entrant’s written description and photograph. The judging panel will include one person independent of the promoter.
  25. The winner and runners-up will be notified in writing within 28 days of the competition closing date. In the unlikely event that any winner is not able to be contacted within a further 28 days, the promoter reserves the right to withdraw the prize entitlement and award that prize to a reserve selected at the same time as the original.
  26. No responsibility can be accepted for entries lost, damaged or delayed in the post. Proof of posting does not constitute proof of delivery and proof of submission does not constitute proof of receipt. Postal entries that include a written submission and photograph will not be returned to Participants.
  27. Purina PetCare is not responsible for network, computer hardware or software jamming or outages of any nature which restrict, slow down or cause the loss of the participant's form or other data.
  28. Participants warrant that when submitting material no intellectual, property or other right of any third party will be infringed. Participants shall hold Purina PetCare free and harmless from any claims, costs, actions, suits and/or damages resulting from infringement or alleged infringement of any right of any third party arising out of the submission of material and/or the use thereof.
  29. Purina PetCare reserves the right to request written proof of residency, written proof that the kitten entered belongs to the entrant and confirmation that the winner is at least 18 before any prize is dispatched.
  30. The address details submitted by the winner are deemed to have been submitted by the authorised user of the e-mail address. Purina PetCare will store the provided information.
  31. The names and counties of the winners and details of the winning entries will be available by sending a SAE to Purina PetCare. These will be available from 12th September 2010 until 5th January 2011.

  33. The promoter’s decision will be final in all matters relating to this promotion and no correspondence will be entered into.
  34. The promoter retains the right to alter the present terms of entry in the interests of the entrant, with no less than 14 days notice, to be posted on the website.
